This document explains how Nira Health may use and disclose your health information and outlines your rights regarding this information. By accessing and using the Nira Health platform and services, you (the "User") agree to be bound by these Terms and Conditions. If you do not agree with any part of these Terms, you may not use the platform. We may update these Terms at any time, and continued use of the platform constitutes acceptance of any changes.
Nira Health provides mental health and wellness recommendations using data-driven insights, including artificial intelligence (AI). Our recommendations supplement mental health management but do not replace professional medical advice or treatment provided by your healthcare team.
We prioritize data security and privacy. Our Privacy Policy outlines how we collect, use, and protect your information. By using Nira Health, you consent to data collection as outlined in our Privacy Policy.
Nira Health may use AI algorithms to assist in providing mental health and wellness recommendations. By using the platform, you acknowledge the following:
Nira Health provides clinical services exclusively to minor patients between the ages of 5 and 17. A parent or legal guardian must provide informed consent on behalf of the minor patient before any services are initiated. By enrolling a child in Nira Health services, the consenting adult represents and warrants all of the following:
When a minor patient reaches the age of 18, the parental or guardian consent on file is no longer valid. A new, independent consent must be executed directly by the patient before services may continue. Nira Health will notify the family in advance of this transition.
Minor patients' health records are accessible to parents and legal guardians except where prohibited by applicable state law. In certain states, minors may have the right to consent to specific categories of care and to keep related records confidential. Nira Health will comply with applicable state law in all such circumstances.
Services are delivered primarily through secure telehealth technologies, which may involve electronic communication and transmission of health information and may have limitations compared to in-person care.
Nira Health does not provide emergency or crisis services. If your child is experiencing a medical or mental health emergency, call 911, contact the Suicide and Crisis Lifeline at 988, or go to the nearest emergency department.

By using Nira Health, Users consent to data collection and processing as outlined in our Privacy Policy. Users may revoke consent at any time, but prior data use will not be affected.
User data will be retained only as long as necessary for operational purposes, compliance with legal obligations, and protection of legitimate business interests. Requests for data deletion may be submitted to info@nira-health.com. Nira Health may retain certain data if legally required or if necessary to protect its interests.
All content on the Nira Health platform, including text, graphics, and AI tools, is the intellectual property of Nira Health. Users may not reproduce, modify, distribute, or reverse-engineer platform content without permission.
Nira Health may provide links to third-party websites or services as a convenience to users. Nira Health does not endorse and is not responsible for any content, advertising, products, or other materials on these third-party sites. Any interactions or transactions with third parties are solely between the User and the third party.
Nira Health reserves the right to terminate or suspend User access to the platform, without notice, if the User violates these Terms, engages in inappropriate conduct, or uses the platform for unlawful activities. Nira Health may also terminate services for technical, legal, or business reasons.
These Terms are governed by the laws of the state in which Nira Health is headquartered, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located within that jurisdiction.
Users agree to attempt resolution of any disputes through negotiation before pursuing legal remedies. In the event that disputes cannot be resolved through negotiation, Users and Nira Health agree to resolve disputes through mediation or arbitration, as appropriate under applicable state laws.
Nira Health reserves the right to modify these Terms at any time. Changes will take effect upon posting to the platform. Users are encouraged to review these Terms periodically to stay informed about updates. Continued use of the platform after any modification constitutes acceptance of the revised Terms.

Nira Health uses the following third-party service providers to operate and deliver its services. Each provider operates under its own terms and privacy policies.
Nira Health is not responsible for the privacy practices or terms of these third-party providers. Use of our services constitutes acceptance that such providers may process your data in accordance with their respective policies.
Atlas is a wellness tracking application and is NOT a diagnostic tool. Atlas does not constitute medical care and is not a substitute for clinical evaluation, diagnosis, or treatment by a licensed healthcare provider. Atlas does not diagnose any condition, recommend medications, or generate clinical assessments of any kind. Observations and patterns surfaced by Atlas are for informational and self-monitoring purposes only.
Data collected through the Atlas application — including behavior logs, sleep data, focus tracking, and parent-reported observations — may be shared with your Nira Health clinical care team only with your explicit, written consent at the time of enrollment in clinical services.
Transitioning from Atlas use to Nira Health clinical care requires a separate clinical intake and consent process. Enrollment in Atlas does not constitute enrollment in Nira Health clinical services, and use of Atlas does not create a patient-provider relationship.
Prior Atlas data will only be incorporated into your child's clinical record upon written authorization provided during the clinical enrollment process. You may choose not to share Atlas data with your care team without affecting your eligibility for clinical services.
Before initiating any formal dispute, Users agree to provide Nira Health with written notice of the dispute at info@nira-health.com and allow 30 days for Nira Health to attempt resolution in good faith.
If a dispute cannot be resolved informally, Users and Nira Health agree that any claim, dispute, or controversy arising out of or relating to these Terms or the use of Nira Health services shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in Nashville, Tennessee.
Class Action Waiver: Users agree to resolve disputes with Nira Health on an individual basis only. Users expressly waive the right to participate as a plaintiff or class member in any class action, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of a class or representative proceeding.
Nothing in this section prevents either party from seeking emergency injunctive or equitable relief from a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Users agree to defend, indemnify, and hold harmless Nira Health, its officers, directors, employees, contractors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
This indemnification obligation will survive termination of your use of the platform and these Terms.
The Atlas application may offer optional paid features, subscriptions, or one-time purchases ("In-App Purchases" or "IAP") processed through Apple App Store in-app purchase mechanisms. By completing an In-App Purchase, you agree to Apple's App Store Terms and Conditions in addition to these Terms.

Clinical Services (Nira Health): Fees for clinical services that have been rendered are non-refundable. If you believe a charge was made in error, contact us at info@nira-health.com within 30 days of the charge. Nira Health will review the request and, at its sole discretion, issue a credit or refund where appropriate.
Atlas In-App Purchases: Refunds for Atlas IAP are governed by Apple's App Store refund policies. Nira Health does not process refunds directly for IAP transactions. To request a refund for an App Store purchase, visit reportaproblem.apple.com or contact Apple Support. Nira Health will cooperate with Apple to support legitimate refund requests.
Subscription Cancellations: You may cancel an Atlas subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period; no partial-period refunds are issued except where required by applicable law.
If you have a dispute about a charge, contact us at info@nira-health.com before initiating a chargeback. We will make a good-faith effort to resolve billing disputes promptly.
